These Terms and Conditions (“Terms”) govern your use of the Aford Fresh website, mobile application, and related services (collectively, the “Platform”), operated by AFORD FRESH (FLY PEACE RETAIL PRIVATE LIMITED), with registered office at Sector 82, JLPL Industrial Area, Sahibzada Ajit Singh Nagar, Punjab 160062
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Eligibility
You must be legally capable of entering into a binding contract under applicable law. If you are using the Platform on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2. Account Registration and Security
– You may register using phone OTP and/or other login methods we provide.
– You agree to provide accurate and current information, including name, phone number, email, and delivery address.
– You are responsible for keeping your account credentials, OTPs, and device access secure.
– You are responsible for all activity under your account unless you report unauthorized use promptly.
3. Products, Pricing, and Availability
– Product images are for illustration; actual product appearance may vary.
– Prices, discounts, offers, and product availability may change without prior notice.
– We reserve the right to limit quantities, cancel orders, or refuse service where required for operational, legal, or fraud-prevention reasons.
4. Orders and Acceptance
– Placing an order is an offer to purchase. Order confirmation does not guarantee acceptance.
– Your order is accepted once we process it for dispatch/pickup and communicate status through the Platform.
– We may cancel or partially fulfill an order due to stock issues, pricing errors, address limitations, safety concerns, or suspected misuse.
5. Delivery and Pickup
– Delivery is available only in serviceable locations determined by our system.
– Delivery timelines are estimates and may be affected by weather, traffic, store load, or other operational issues.
– You must provide accurate address/location details for successful delivery.
– Where enabled, store pickup may be offered under separate operational timings and conditions.
6. Payments
– We support one or more payment options such as UPI, cards, net banking, wallet, and cash on delivery (COD), subject to availability.
– Online payments may be processed through third-party payment gateways (including PhonePe, where applicable).
– You authorize us and our payment partners to process your transaction for the final payable amount.
– If payment fails or is reversed, the order may be cancelled or held until successful payment.
7. Wallet, Coupons, and Promotions
– Promotional offers, wallet credits, and coupon codes are subject to eligibility, validity periods, minimum order value, and additional campaign terms.
– We may modify, suspend, or withdraw promotions at any time.
– Abuse, multiple-account misuse, or fraudulent redemption may lead to cancellation of benefits and account action.
8. Cancellation, Returns, and Refunds
– Order cancellation is permitted only within the timeline shown at checkout/order details.
– Certain products may be non-returnable due to hygiene, perishability, or regulatory reasons.
– Refunds/replacements for damaged, missing, wrong, or quality-issue items are governed by our Refund Policy.
– Approved refunds are processed to the original payment mode or platform wallet, depending on method and operational policy.
9. User Conduct
You agree not to:
– use the Platform for unlawful, fraudulent, or abusive purposes;
– interfere with Platform security, APIs, or system operations;
– submit false claims, fake reviews, or misleading information;
– infringe intellectual property or other rights;
– attempt unauthorized access to other accounts or backend systems.
10. Intellectual Property
All Platform content, branding, software, design, text, graphics, and logos are owned by or licensed to Aford Fresh and are protected by applicable intellectual property laws. You receive a limited, non-transferable right to use the Platform for personal, non-commercial shopping use.
11. Third-Party Services
We may rely on third-party providers for payments, maps/location, push notifications, analytics, logistics, and communications. Their services are governed by their own terms and privacy practices.
12. Disclaimer and Limitation of Liability
– The Platform is provided on an “as is” and “as available” basis.
– To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms.
– We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business.
– Our aggregate liability for any claim arising out of your use of the Platform shall not exceed the amount paid by you for the relevant order giving rise to the claim.
13. Indemnity
You agree to indemnify and hold harmless Aford Fresh, its affiliates, officers, employees, and partners from claims, losses, liabilities, and expenses arising from your misuse of the Platform, breach of these Terms, or violation of law.
14. Suspension and Termination
We may suspend, restrict, or terminate your account or access if we reasonably believe there is fraud, abuse, security risk, legal non-compliance, or breach of these Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Courts at [City, State], India will have exclusive jurisdiction, subject to any mandatory dispute resolution requirements under applicable law.
16. Changes to Terms
We may update these Terms from time to time. Revised Terms will be posted on the Platform with an updated date. Continued use after updates constitutes acceptance of the revised Terms.
